1. Agreement to Terms
By downloading, installing, or using the Insync Fitness mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.
The App is operated by Insync Fitness (“we”, “us”, or “our”). These Terms govern your access to and use of the App and any related services we provide.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you confirm that you have your parent or guardian’s consent to use the App. By using the App, you represent that you meet these age requirements.
3. Account Registration
To access certain features, you must create an account using a valid email address or a supported third-party sign-in provider (Apple, Google). You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Description of Service
Insync Fitness is a fitness and wellness application designed for women that provides:
- Menstrual cycle tracking and phase-based insights
- Workout tracking with cycle-phase-aware performance analysis
- Community features including groups, posts, events, and leaderboards
- Business accounts for fitness professionals and studios
- Content including exercise guides, health insights, and wellness tips
The App is intended for general wellness and fitness tracking purposes only. It is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
5. Health Disclaimer
IMPORTANT: The App provides general fitness and cycle tracking information. It does not provide medical advice.
- Menstrual cycle predictions and phase calculations are estimates based on the data you provide. They are not guaranteed to be accurate.
- Workout recommendations based on cycle phases are general guidelines. Always consult a healthcare professional before starting any exercise program.
- Do not rely on the App for contraception, fertility planning, or diagnosis of any medical condition.
- If you experience any health concerns, consult a qualified healthcare professional.
6. User Content
You may create content through the App, including community posts, comments, workout data, and profile information (“User Content”). By submitting User Content, you:
- Retain ownership of your User Content
- Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content within the App for the purpose of providing the service
- Represent that your User Content does not infringe the rights of any third party
- Acknowledge that User Content shared in communities is visible to other community members
You must not post content that is:
- Illegal, harmful, threatening, abusive, or harassing
- Sexually explicit or pornographic
- Discriminatory based on race, gender, religion, disability, or sexual orientation
- Spam, advertising, or unsolicited promotion
- Impersonating another person or entity
- Containing malware, viruses, or harmful code
We reserve the right to remove any User Content that violates these Terms without prior notice.
When participating in communities, you agree to:
- Treat other members with respect and courtesy
- Not bully, harass, or intimidate other users
- Not share other users’ personal information without consent
- Follow the rules set by community administrators
- Report inappropriate content or behavior
Community administrators may remove members or content at their discretion.
8. Business Accounts
Business account holders (gyms, studios, trainers) are additionally responsible for:
- Providing accurate business information
- Ensuring their business operations comply with applicable laws
- Managing their community members appropriately
- Not misrepresenting their qualifications or services
9. Intellectual Property
The App, including its design, features, code, content, logos, and trademarks, is owned by Insync Fitness and protected by intellectual property laws. You may not:
- Copy, modify, or distribute any part of the App
- Reverse engineer, decompile, or disassemble the App
- Use our trademarks or branding without written permission
- Scrape, harvest, or collect data from the App by automated means
10. Privacy
Your use of the App is also governed by our Privacy Policy, available at https://insynctracker.com/privacy/. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
We collect and process sensitive health data including menstrual cycle information, workout performance data, mood and symptom tracking, and body measurements. This data is stored securely and is not sold to third parties.
11. Subscriptions and Payments
Certain features of the App may require a paid subscription. If applicable:
- Subscription prices are displayed in the App before purchase
- Subscriptions are billed through the Apple App Store or Google Play Store
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage and cancel subscriptions through your device’s app store settings
- Refunds are handled according to the policies of Apple or Google
12. Third-Party Services
The App integrates with third-party services including:
- Supabase for data storage and authentication
- PostHog for analytics
- Apple and Google for sign-in services
We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is subject to their own terms and policies.
13. Limitation of Liability
To the maximum extent permitted by law:
- The App is provided “as is” and “as available” without warranties of any kind, whether express or implied
- We do not warrant that the App will be uninterrupted, error-free, or secure
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
- Our total liability to you for any claims arising from your use of the App is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater
- We are not liable for any health outcomes resulting from reliance on information provided by the App
14. Indemnification
You agree to indemnify and hold harmless Insync Fitness, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your User Content
- Your violation of any rights of another person or entity
15. Account Termination
We may suspend or terminate your account at any time if:
- You violate these Terms
- Your account is used for fraudulent or illegal purposes
- We are required to do so by law
- We discontinue the App or any part of it
You may delete your account at any time by contacting info@insynctracker.com. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
16. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page
- Notify you through the App or by email
- Where required by law, obtain your consent to the updated Terms
Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
For users outside the United Kingdom, you may also be entitled to protections under the consumer protection laws of your country of residence.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Insync Fitness regarding your use of the App.
